Terms and conditions

The online shop www.joliorigins.cz is operated by Jitka Vrňáková, Korunní 2569/108, 101 00 Prague 10, Czech Republic, company ID 08670340 (the “seller”). Contact: info@joliorigins.cz.

1. Introductory provisions

These terms govern the mutual rights and obligations of the seller and a natural person who concludes a purchase contract outside their business as a consumer (the “buyer”) through the web interface at www.joliorigins.cz. The legal relationship is governed by Act No. 89/2012 Coll., the Czech Civil Code, and Act No. 634/1992 Coll., on consumer protection.

The terms form an integral part of the purchase contract. The contract and terms are drawn up in Czech; this English version is provided for information and the Czech wording prevails in case of conflict.

2. Conclusion of the contract

The presentation of goods on the website is for information only; Section 1732(2) of the Civil Code does not apply. Prices are final. Shipping to European Union countries is free regardless of order value.

The buyer orders by completing the order form, clicking “Continue to payment” and completing the payment. Before submitting, the buyer can check and change the entered details. The contract is concluded when the payment is received; the seller confirms the order by e-mail.

The cosmetics are made to order in small batches. The seller ships within 3 working days of receiving payment unless stated otherwise for a product.

3. Price and payment

The buyer pays in advance by card, Apple Pay or Google Pay through the Stripe payment gateway. The seller never receives card details. The obligation to pay is fulfilled when the amount is credited to the seller’s account.

In the English version of the shop prices are converted to EUR at the daily rate of the Czech National Bank and rounded to whole euros; the EUR payment is final.

The seller issues an invoice after payment and sends it electronically to the buyer’s e-mail address.

4. Delivery

We deliver to all member states of the European Union. Within the Czech Republic usually 1–2 working days from dispatch, in other EU countries 3–7 working days. A tracking number is sent by e-mail.

On receipt the buyer should check that the packaging is intact. We recommend reporting visible damage to the carrier on receipt and to the seller without undue delay.

5. Withdrawal from the contract

The buyer may withdraw from the contract without giving a reason within 14 days of receiving the goods (Section 1829 of the Civil Code). Withdrawal may be sent to info@joliorigins.cz or to the seller’s address; the deadline is met if the withdrawal is sent within it.

Under Section 1837(g) of the Civil Code, withdrawal is not possible for goods in sealed packaging which are not suitable for return for health or hygiene reasons once the seal has been broken. Opening the outer carton alone does not trigger this exception; it depends on breaking a hygienic seal and the nature of the goods.

The buyer returns the goods within 14 days of withdrawal and bears the cost of return. The seller refunds the received payment within 14 days of withdrawal, but not before receiving the goods or proof of their dispatch, using the same payment method. The buyer is liable for any reduction in value caused by handling beyond what is necessary to establish the nature and properties of the goods.

6. Defective performance

The seller is liable that the goods are free of defects on receipt and have the properties described. The buyer may claim a defect that appears within two years of receipt; for cosmetics with a marked shelf life that period applies if shorter.

The shelf life is marked on the packaging and applies to unopened products stored at room temperature away from direct sunlight. After opening we recommend using the product by the date on the packaging.

Claims are made without undue delay at info@joliorigins.cz with a description and photograph of the defect. The seller decides on and settles the claim within 30 days at the latest.

7. Personal data

Information on the processing of buyers’ personal data is set out in the separate Privacy policy available on the website.

8. Out-of-court dispute resolution

The Czech Trade Inspection Authority (Česká obchodní inspekce, Štěpánská 567/15, 120 00 Prague 2, www.coi.cz) is competent for the out-of-court resolution of consumer disputes. Consumers may also use the online dispute resolution platform at ec.europa.eu/consumers/odr.

The seller is not bound by any codes of conduct within the meaning of Section 1826(1)(e) of the Civil Code.

9. Final provisions

Where the relationship contains an international element, Czech law applies; this does not affect consumer rights under the mandatory law of the consumer’s country of residence.

If any provision is invalid or ineffective, it is replaced by a provision whose meaning comes closest to it. The seller may amend these terms; rights and obligations arising during the validity of the previous wording are not affected.
